Legal Liability after the Mezzouna Tragedy: Who is Responsible for the Student Deaths?

Jawhar El Qabsi, spokesperson for the Court of First Instance of Sidi Bouzid, said that the public prosecutor acted immediately following the collapse of a wall at the high school in the municipality of Mezzouna, in the eastern part of the Sidi Bouzid governorate. The incident resulted in the deaths of three students and injuries to others, with varying degrees of severity.

In a statement to Diwan radio, he stated that investigations have been opened against any individuals identified in the inquiry for involuntary manslaughter and injuries caused by negligence, lack of precaution, or carelessness, following Articles 217 and 225 of the Penal Code.

El Qabsi added that an investigating judge went to the scene to carry out the required findings as part of the investigation, which has been entrusted to one of the central units of the National Guard in Aouina. In an interview with Jawhara FM, he stressed that the investigation is still ongoing and that responsibility will be established. Prosecutions will be initiated against anyone found to have shown negligence or failed in their duty to ensure proper maintenance work.

What do Articles 217 and 225 of the Penal Code stipulate?

  • Article 217 of the Penal Code states:
    “Anyone who commits or is responsible for involuntary manslaughter due to negligence, lack of precaution, recklessness, or failure to comply with the law shall be punished by two years’ imprisonment and a fine of 720 dinars.”

  • Article 225 provides:
    “Anyone who, through negligence, ignorance of their obligations, lack of precaution, carelessness, or non-compliance with the law, causes bodily harm to another person or is involuntarily responsible for such harm shall be punished by one year of imprisonment and a fine of 480 dinars.”
