Tunisia – I Watch files complaint against ISIE for abuse of power

“I Watch” revealed that it filed, today Thursday, a complaint for abuse of power and a request for postponement and suspension of the execution of the decision of the Independent High Authority for Elections regarding the establishment of the final list of candidates for the 2024 presidential election, issued on September 3, 2024, in the Official Gazette of the Tunisian Republic.

The organization considered, in a statement, published today Thursday, that “what the authority has done comprises a flagrant violation of the administration’s duty to execute judicial decisions and protect the acquired rights of litigants”.

It added that the failure of the Electoral Commission to comply with the decisions of the administrative court “constitutes a grave violation of the law”.

It explained that its complaint is founded on several objections related in particular to the Commission’s incorrect interpretation of the law on elections, the violation of constitutional principles, the principle of separation of “powers” and the breach of the principle of restricted authority of the administration and administrative customs.

Last Monday, the Independent High Authority for Elections declared the list of candidates finally selected for the presidential election, namely Zouhair Al-Maghzawi, Kais Saïed and Ayachi Zammel, and this list was published in the official gazette of the Republic of Tunisia.

The Electoral Commission also declined to accept the inclusion of Abdellatif Makki, Mondher Zenaidi and Imed Al-Daïmi on the list of candidates finally accepted for the next elections after the administrative court issued decisions annulling the Commission’s previous decisions to reject their candidacy files.

The President of the Authority, Farouk Bouasker, explained this refusal as “the impossibility of implementing the decisions disclosed by the Administrative Court and of considering the list of successful candidates approved by the Council of the Authority held on August 10, 2024 as a definitive list.
