Tunisia- Minister of Defense: Military magistrates are independent

National Defense Minister Brahim Bartagi was auditioned on by the Parliamentary Committee on the Organization of Administration and Armed Forces Affairs in relationship with MP Rached Khiari case.

Mr Bartagi stated that according to the constitution, law and morals, his ministry has no right to intervene or even give an opinion when it comes to an ongoing matter.

The Ministry of Defense is part of the Executive Branch and hence has no jurisdiction over military magistrates who are independent in the exercise of their function and are subject only to the rule of law.

Concerning the mandate against Rached Khiari, which was leaked and widely shared on social networks, Mr Bartagi pointed out that the leak did not come from his ministry, adding that never a document relating to the ministry of Defense was leaked.
