Tunisia: New decree-law amends rules governing criminal reconciliation

Decree-Law No. 2 of 2026, amending Decree-Law No. 13 of 2022 of March 20, 2022, on criminal reconciliation and the allocation of its proceeds, was published in the Official Gazette of the Republic of Tunisia (JORT) on Wednesday, September 30, 2026.

The decree-law follows its review by a ministerial council held on Tuesday at Carthage Palace, chaired by President Kais Saied.

At least 50% payment for provisional reconciliation

The amendment to Article 25 of the 2022 decree-law allows for the proposal of a provisional reconciliation agreement involving the payment of at least 50% of the financial amounts due.

The applicant must also undertake to pay the remaining amount within the timeframe proposed by the commission. This period may not exceed two years.

The provisional reconciliation proposal must be based on concrete and serious elements submitted by the applicant.

    Allocation of criminal reconciliation proceeds

The amendment also concerns Article 30, relating to the allocation of proceeds generated by criminal reconciliation.

Under the new provisions, these revenues will be allocated to financing the projects referred to in the first paragraph of the article, in accordance with decisions taken by the National Security Council.

Commission may propose a lower rate

The amended text further provides that the commission may, where appropriate and in all cases covered by the decree-law, propose a lower rate when it considers this justified.

The amendments therefore introduce new provisions concerning payment conditions, repayment deadlines and the allocation of revenues generated through criminal reconciliation.
