Tunisia-Parliament: Adoption of bill relating to medical liability

MPs of the Parliament voted article by article on the bill submitted, requiring a majority of at least one-third of the members of Parliament (54 members) for each vote. Ultimately, the law was adopted with 108 votes in favour, 3 abstentions and 5 votes against.

This bill, designated under number 41/2019, seeks to guarantee patients’ rights and provide legal protection to physicians by establishing a precise legal framework concerning medical liability.

Initially taken care of by the former Health Committee since May 30, 2019, the text was read in a plenary session on July 31, 2019, then again in January 2020. During this second evaluation, it was referred to the new health commission of the Parliament where a crucial question emerged: determining the party responsible for compensation for damages. Insurance companies have declined to guarantee full compensation for patients in the event of medical error.
