Algeria-Tunisia Agreement for the Extradition of Convicted Individuals Between the Two Countries

Algeria and Tunisia have taken a new step in their judicial cooperation by adopting an Algerian presidential decree formalizing a bilateral agreement on the extradition of criminals.

This decree, signed by President Abdelmadjid Tebboune on Tuesday, seeks to facilitate the transfer of convicted individuals between the two countries to strengthen the fight against transnational crime.

Strict Criteria for Extradition
The deal stipulates that any person convicted to at least one year of imprisonment can be extradited, provided that the remaining sentence to be served is at least six months at the time of the request.

A key aspect of this treaty is that it applies even if the two countries’ legal systems classify offences differently. This means that a person prosecuted for a crime in one of the two states can be extradited even if the offence has a different legal qualification in another country.

Strengthened Framework for Combating Tax Fraud
The agreement also specifies that tax crimes cannot be used as a reason to deny extradition. In other words, a person prosecuted for tax fraud, evasion, or any other financial offence can be handed over to the authorities of the requesting country, even if the tax laws of the two states differ.

This agreement reflects the commitment of the Algerian and Tunisian governments to enhance their security and judicial cooperation, at a time when the fight against organized crime and corruption remains a shared priority.
