Tunisia-Abderrazzek Mokhtar: The 2014 constitution and decree 117 do not authorize the dissolution of the CSM [Audio]

Remarking on the last discourse of the President of the Republic Kais Saied, professor of constitutional law Abderrazzek Mokhtar said that there are two constitutions in Tunisia. “The 2014 constitution that was halted and Presidential Decree No. 117. The 2014 constitution does not permit, under any circumstances, the dissolution of the Superior Council of the Judiciary (CSM). Furthermore, decree 117 relating to the implementation of exceptional measures was drawn up to avoid “the imminent danger” that is the Parliament according to the Head of State Kais Saied. Thus, the decree could not allow interference in the judiciary and the dissolution of the CSM,” he said, clarifying that the decisions that will be taken by Saied in this regard will be illegitimate.
