Tunisia-[Audio ] Imed Ben Halima: Imed Ben Halima explains Fakhfekh’s resignation from a constitutional point of view

Lawyer and political activist Imed Ben Halima affirmed that article 98 of the constitution states that “The resignation of the Head of Government entails the resignation of the entire government. The resignation shall be submitted in writing to the President of the Republic who notifies the Speaker of the Assembly of the Representatives of the People. “.

In a statement to Tunisie Numérique, he indicated that under this article, the President of the Republic cannot reject the resignation of the head of government but he accepts it automatically.

The lawyer added that when the government resigns, it is no longer accountable to the Assembly of People’s Representatives, as stipulated in article 95.

From then on, the government became a caretaker Government until the person responsible for forming a new government completed his mission within the constitutional timeframe, that is, within a month.

 

The lawyer, in this sense, explained that it is the president of the republic will assign the person who is most capable to form the government in accordance with the provisions of Article 89.

According to Ben Halima, constitutionally speaking, the President of the Republic can command the same person to form a government. “There is no problem if the president of the republic designates Fakhfekh again to form a government,” he said.

The lawyer ended up affirming that there are two hypotheses; either the next government can pass and the future PM to help Tunisia to overcome its crisis or the President of the Republic will give Tunisians the opportunity to elect a new parliament, he said.
