MPs, politicians and attorneys have stated on numerous occasions that this abrupt wish on the part of the ruling parties to accelerate the process of setting up the Constitutional Court is in fact because this institution is the exclusive one that is constitutionally competent to dismiss the President of the Republic from office.

Speaking to Tunisie Numérique, constitutional law expert Mouna Kraiem asserted that to remove the President of the Republic from office, Parliament needs first to issue to the Constitutional Court (once created) a motion of censure motivated and backed in plenary by 2/3 of the deputies.

Then, the Constitutional Court will be asked to examine the motivations of the deputies and to rule whether or not there was “a grave breach of the provisions of the constitutions”, explained Mrs Kraiem.

Only the Constitutional Court could take such a decision, she stated, adding that the role of this institution is not restricted to trail the Head of State to trial since it has powers making it an indispensable institution in a democracy.
