Tunisia-[Audio]Hana Ben Abda: Bouden government and the question of taking the oath

Speaking to Tunisie Numérique, Constitutional law professor Hana Ben Abda stressed that the Bouden government does not require to gain the confidence of parliament. The lawyer revealed that Bouden government is governed by Decree 117 relating to exceptional measures and not by article 89 of the constitution.

This does not prevent members of the government from taking the same constitutional oath presented in article 89 of the constitution, because decree 117 stipulates in article 16 that “The prime minister and members of the Government take the oath before the President of the Republic provided for in the last paragraph of article 89 of the Constitution ”.
