Tunisia – Deaths of Infants at Wassila Bourguiba Hospital: Harsh Prison Sentences and Fines for the Complainants

The Criminal Division of the Tunis Court of Appeal found the defendants guilty in the case regarding the deaths of infants at the Association Hospital and condemned them to eight months in prison for each of the fourteen cases published against them.

The Criminal Division also imposed a fine of 30,000 dinars on each family affected by the death of their child.

The three defendants did not profit from the “cumulative” sentence, resulting in prison sentences totaling more than ten years. The three defendants—the director of the obstetrics and neonatology center, the director of maintenance, and the director of the pharmacy department at the same center—were accused of supplying materials or performing a defective act resulting in involuntary manslaughter within the meaning of Article 315 of the Penal Code.
