Tunisia-Draft Constitution: Article 1 without reference to Islam

According to the draft Constitution, issued in the JORT this Thursday, June 30, any reference to Islam has been withdrawn from Article 1. Indeed, this article now stipulates that “Tunisia is a free, independent and sovereign state”.

Nevertheless, the preamble insists on Tunisia’s belonging to the Arab nation and its attachment to the human dimensions of Islam. Article 5, stipulates that Tunisia is part of the “Islamic nation” and of the Maghreb and that solely the State must work to concretize the objectives of Islam.
The draft of the new Constitution, consequently, does not refer to Islam as the religion of the State, but article 84 (Chapter 4 / 1st part) notes that the President of the Republic must be a Muslim.
