The Tunis Court of Cassation, on Wednesday, March 6, 2024, examined the appeal lodged by the defence team of journalist Khelifa Guesmi, a correspondent for Mosaique FM in Kairouan. This appeal was against the ruling issued by the Tunis Court of Appeal on May 15, 2023, which condemned him to five years in prison.
The Court of Cassation in Tunis resolved to cancel the decision of the Court of Appeal and referred the case back to the first instance for re-examination. As a direct consequence of this decision, the appellate court’s judgment is voided. Following this command, Khelifa Guesmi was released and departed from Mornaguia prison that evening.
Originally condemned to a year in prison at the first instance, the Tunis Court of Appeal had escalated Guesmi’s sentence to five years. Despite the cassation appeal, Guesmi was apprehended and incarcerated in September, even though he was entitled to remain free until the adjudication of his cassation trial.
