Attorney Imed bin Halima reflected on the legal proceeding presented by 30 former MPs from the National Constituent Assembly to the Administrative Court to revoke the president of the republic Kais Saied’s decision to freeze parliament.
Mr Helima told Tunisie Numérique that under Article 80, the exceptional measures adopted by the President of the Republic are applied immediately and it is not permissible to request a partial or full review of them. He pointed out that the President of the Republic has the freedom regarding the date of ending the exceptional measures.
Chapter 80 further defines the bodies legally authorized to request a review of these procedures, which is the house speaker or 30 MPs, said our speaker.
Mr Ben Halima affirmed that the head of the state decisions is deemed as sovereign decisions, hence they are not subject to the supervision of the administrative judge and are outside his jurisdiction.
