The Party of the Third Republic reported that it had filed, Monday, with the Administrative Court an appeal and a request for suspension of the application of Regulatory Resolution No. 544 issued by the ISIE, regarding the new conditions of the elections.
The party believed, in a press release, that this decision “excluded Tunisian youth and Tunisians abroad from the presidential elections in flagrant breach of the electoral law and the constitution”, underlining that this appeal is part of the defence of the rights of the president of the party, Olfa El-Hamdi, who had formerly announced her intention to run in the presidential elections.
The ISIE issued Ordinary Resolution No. 544 of July 4, 2024, revising and supplementing Resolution No. 18 of 2014 relating to the rules and procedures for candidacy for presidential elections, which included the addition of new chapters and the modification of certain other chapters, stipulating in particular that the candidate for the presidential election must be a “Tunisian” not having another nationality, born of a father, a mother and a maternal grandfather, all Tunisians without interruption, following article 89 of the Code. Constitution.
This regulatory decision furthermore included a new requirement regarding the age of the candidate, which stipulates that “he must be at least forty years old on the day of submitting his candidacy per article 89 of the Constitution”.
