Tunisia-Sadok Belaïd: Kais Saied’s decisions derive their legitimacy from the will of the people and not from respect for the constitution

Constitutional law expert Sadok Belaid announced that the prolongation of the state of emergency by the President of the Republic was foreseeable given that Kais Saied had announced from the outset that the one-month period was renewable.
According to the constitutional text, the exceptional measures must conclude 30 days after their entry into force, renewable only once, he revealed. Nevertheless, presidential decisions do not derive their legitimacy from the rigorous application of constitutional provisions, “because let’s be honest, from the commencement the President of the Republic has gone outside the constitutional framework”, he emphasised .
Decisions taken after July 25 are based on the will of the people which forms an even more solid basis than any legal text, Belaid added.
