Mabrouk Korchid: “The Constitution prevents Saied from forming a new government without presenting it to Parliament”

Mabrouk Korchid announced on his page that the formation of the government has become an obstruction for the President of the Republic.

“The unconquerable obstacle before the Presidency of the Republic: Article 89 of the Constitution, as well as the incapability to form a government and call for early elections. It has become apparent that the main obstacle facing the President of the Republic is the formation of a new government after the removal of the Mechichi government, “he said.

“The reason for this incapacity, which lasted forty days, is the Constitution itself, which the President of the Republic wants to apply, even going so far as to approve measures against Parliament, in terms of freezing or suspension, and the lifting of the immunity of deputies, ”he added.

The provisions of the Constitution, which the President of the Republic wants to respect until they are amended, stop the formation of a new government without being presented to Parliament and this is within the meaning of Article 89, which specifies that each new government must be submitted to the confidence of Parliament. As a result, any government formed outside the Constitution is considered unconstitutional, according to Korchid, which means that it will not be recognized internationally and that its ministers will sooner or later be subjected to legal action. Adding that article 89 of the Constitution conditions the organization of early elections after the dissolution of Parliament and within 90 days. Nevertheless, Parliament has not been dissolved until today but suspended.

“That’s why I stated earlier, that the crisis is political and constitutional. We must opt ​​for rationality as a resolution to the successive crises in Tunisia, and the first condition for rationality is dialogue, ”he said.
