Dutch court suspends delivery of F-35 parts to Israel

On Monday, February 12, 2024, a Dutch court issued an order instructing the Netherlands to stop the delivery of parts for F-35 fighter jets operated by Israel in the Gaza Strip. The ruling came in response to a case brought forward by human rights organizations, with the Court of Appeal in The Hague stating, “The court orders the State to halt all actual export and transit of F-35 parts to the final destination Israel within 7 days of service of this judgment.”

This decision topples the initial verdict delivered in this matter. Previously, the Hague District Court had ruled in December that such provisions were primarily a political decision beyond the scope of judicial interference.

The controversy surrounding these deliveries arose in November, with Dutch authorities voicing uncertainty regarding their authority to intervene in the deliveries, which were conducted as part of a broader operation under the auspices of the United States to supply spare parts to all F-35s from partner countries.
