Tunisia- Admiral Akrout: Decree regulating state of emergency must be abolished urgently

Admiral Kamel Akrout stated that in theory the House of People’s Representatives should oversee the executive branch and pass laws However it doesn’t do any of that.

According to him, some texts must be abolished as soon as possible, in particular, Decree No. 78-50 of January 26, 1978, regulating the state of emergency, to give the floor for new rules more accustomed to the current context.

Denouncing that the Draft Organic Law n ° 2018/91 relating to the organization of the state of emergency has still not been approved, the Admiral indicated that the aforementioned regulation is outdated and is not upholding human rights, since it grants the armed security and military forces immense prerogatives.

He called on the legislature to cancel the 1978 regulation as soon as possible in order to shield citizens’ civil and political rights, but also to help security officials and the military in their mission of protection.
