Tunisia- Judicial Council calls on magistrates to preserve the independence and prestige of the judiciary

The Judicial Council affirmed that freedom of expression is a fundamental guarantee of the independence of the judiciary, ensuring that the judge has the right to express his opinion on social networks while ensuring a balance between his freedom and the need to preserve its impartiality, the prestige of the judiciary and its independence.

The Judicial Council stressed that the judge should refrain from publishing anything that would include support for a party or political entity or violate the constitution and locally and internationally approved laws.

He added that the judge should, when using social media, refrain from divulging the secrecy of the proceedings or expressing an opinion or comment in any way on the cases before him and the inclination. for the exercise of the freedoms guaranteed by the constitution within the legal limits while avoiding anything which damages his reputation, the reputation of his colleagues or the reputation of the judicial bodies.

The Council indicated that this information is addressed to the Minister of Justice, the Inspector General of the Ministry of Justice and officials of courts and judicial institutions.

He also underlined that the implementation of the content of these recommendations starts from its publication and ends with the publication of a code of ethics for judges and its dissemination to all judges.
