The president of the Superior Council of the Magistracy, Youssef Bouzakher stressed, that the President of the Republic, Kais Saied talked on numerous occasions with the judicial structures about important cases, in particular judicial reformation. Affirming that yesterday’s meeting centred on the report of the Court of Auditors and the files of the fight against corruption and the obstacles confronted by the justice system.
Regarding the calls to dissolve the CSM, Mr Bouzakher told a private radio that he considered that this forms a suspension of article 5 of the Constitution, and has a direct influence on the protection of rights and freedoms since the judiciary is the guarantor of the rights of people. ”
It is out of the question to keep the chapter of rights and freedoms of the constitution without retaining that of the judiciary and the presence of the CSM”, he continued.
“The dissolution of the CSM is an abolition of judicial power and guarantees of the profession of magistrates, and we are accordingly committed to the constitutional gains relating to the judicial sector,” he said. He further explained that judicial reform is an urgent requirement, however, it cannot be achieved by abolishing the CSM, which has no role in the delivery of judgments in cases and their deadlines, emphasising that judges adhere to reform.
