Tunisia- Imed Ben Halima [audio]: Article 72 does not provide for the dissolution of Parliament

Lawyer and political activist Imed Ben Halima told Tunisienumerique that he has requested the President of the Republic since July 25 to dissolve parliament in accordance with article 77 of the Constitution. Stressing that said article permits the president to do so, particularly in case of danger.

Ben Halima confirmed his support for the dissolution of parliament in accordance with Article 77, not 72, on which Said counted. Indeed, Article 72 says that the President is a symbol of the unity of the state and ensures the application of the law and has nothing to do with the dissolution of Parliament. Our speaker considered that Saïed’s recourse to Article 72 was a chance for his opponents to prove that he was breaking the law. Ben Halima ruled out altering the political and electoral dates set by Saied previously, revealing that there are no constitutional deadlines imposed on the president to organize the early elections.
