Speaking to Tunisie Numérique, Chairman of the General Legislation Committee Yasser Al-Qorari stated that on December 29, 2023, the presidency of the republic referred to the parliament the draft law related to amendments of article 13,2022 related to penal reconciliation and employing its revenues.
He noted that the General Legislation Committee will begin hearings on Friday with the concerned stakeholders before discussing and approving related articles and then referring the report to the council bureau before presenting it to the plenary session. The draft contains 51 articles, amendments included 17 with the most prominent being the expansion of the pejorative of the National Committee for Penal Reconciliation through deepening inquiry and reaching all contacts to present needed information for its work and allow the committee of experts to determine the financial value of the penal settlement
He pointed out that the penal reconciliation code referred to the presidency of the republic who in return showed it to the National Security Council, noting that it later referred to the responsible for state disputes who take charge of striking a deal with the one involved in the dispute whether temporary or final.
The deal then is referred to the minister of justice who takes charge of preparing a certificate for the procedures of reconciliation which is later referred to the public prosecutor which allows stopping judicial procedures against the individual if it’s a final deal.
In case, the track of reconciliation is not finished the responsible for state disputes notifies the minister of justice to resumePenal consequences, he noted that the committee of experts takes charge of the matter and within 20 days it prepares a report, and the reconciled one has the right to challenge within a week.
