Tunisia: Syndicate of Magistrates calls for a revision of the composition and prerogatives of the CSM

The Syndicate of Tunisian Magistrates reported on February 8, 2022, that its representatives met with the Minister of Justice, Leila Jaffel. The Syndicate reflected its position of refusal of the dissolution of the Superior Council of the Judiciary and wishes to keep it as a representative body of the judiciary, suggesting the modification of its composition and its prerogatives.

The Union made during the meeting, reference to its reform project formerly proposed, revealing its support for the independence of the CSM vis-à-vis the executive power. Highlighting the necessity for reform to support the independence of the judiciary and the need to set in place institutional mechanisms that would guarantee that the council performs its functions independently of political interference.

The union called for the adoption of elections as a mechanism for picking the magistrates who are members of the council, the lessening of the duration of the mandate of the members and the modification of the prerogatives of this council. In another context, the Syndicate called for modifying the law governing the inspection of the Ministry of Justice, remarking that the sanction does not rhyme with the denigration of the judiciary.
