Tunisia-Presidential decree for the creation of a commission responsible for the restitution of embezzled funds

A commission responsible for the restitution of looted funds has just been constructed at the Presidency of the Republic by virtue of a presidential decree.

The decree in question, published in the 108th issue of the Official Journal of the Republic of Tunisia (JORT) stipulates in article 2 that the commission’s mission is to evaluate the measures taken for the restitution of the looted funds. It also has the competence to propose measures in this direction.
Article 3 of the decree dated October 22 relates to the composition of the commission, which has 7 members chaired by the Minister of Foreign Affairs and his representative.

The commission brings together the head minister of the presidential cabinet or his representative, the Minister of Justice or his representative, the Minister of the Economy or his representative, the Minister of State Domains or his representative, the Governor of the Central Bank or his representative and the general litigation officer of the State or his representative.

The president of the commission convenes a meeting within a period not exceeding one month of the publication of the presidential decree and fixes its internal regulations and its working method. Every three months, the commission submits a report to the President of the Republic on its activities and the progress of its work, according to article 4 of the decree.

On September 14, President Kais Saied announced the creation of a commission to monitor cases relating to funds embezzled abroad as well as all violations related to public property in Tunisia and abroad.
