Tunisia-[Audio]Salsabil Klibi: Article 80 allows Kais Saied to appoint prime minister

Speaking to Tunisie Numérique, public law professor Salsabil Klibi said that activating article 80 and decreeing a state of emergency leads to an implicit halt of the other provisions of the constitution. Furthermore, the President of the Republic has already pointed out that he will appoint “a Prime Minister” who will be responsible  only to the President of the Republic.

 

This means that he will not go through the procedure provided for in article 89 of the constitution, she revealed. Consequently, in addition to the suspension of the work of the parliament, the head of state has ruled out any future connection between the latter and the prime minister he will appoint.

In fact, under Article 80, the President of the Republic can make any arrangements he considers necessary, including the appointment of a person to help him manage the executive power. The state of emergency is definitely the fact of renouncing the principle of the separation of powers, setting the constitution on hold and putting all powers in the hands of the President of the Republic, she added.
